User Agreement – Terms of Use

1. Introduction and Acceptance

Welcome to Swabhimaan, a platform owned and operated by Swabhimaan Eldertech Private Limited ("Swabhimaan", "we", "us", or "our"). By accessing or using our website, mobile application, or any related services (collectively, the "Platform"), you agree to be legally bound by this User Agreement and all policies referenced herein, including our Privacy Policy and Refunds and Cancellation Policy.

If you do not agree to these terms, you must immediately stop using the Platform. Your continued use of the Platform after any changes to this Agreement constitutes your acceptance of the updated terms.

2. Eligibility

You must be at least 18 years of age to register an account and use the Platform independently. If you are registering on behalf of a senior citizen family member, you represent that you have the authority and consent to do so. By using the Platform, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to enter into a binding agreement.
• You are not prohibited from using the Platform under applicable laws in India or your jurisdiction.

3. Account Registration

To access certain features of the Platform, you may be required to create an account. When registering, you agree to:

• Provide accurate, current, and complete information.
• Maintain and promptly update your account information.
• Keep your login credentials confidential and not share them with others.
• Notify us immediately of any unauthorized use of your account.

You are solely responsible for all activities that occur under your account. Swabhimaan is not liable for any loss resulting from unauthorised use of your account.

4. User Conduct and Prohibited Activities

When using the Platform, you agree not to engage in any of the following:

• Submitting false, misleading, or fraudulent information.
• Impersonating any person or entity, or falsely claiming affiliation with any organisation.
• Attempting to gain unauthorized access to any part of the Platform or its infrastructure.
• Using the Platform for any unlawful, harmful, or discriminatory purpose.
• Uploading or transmitting viruses, malware, or any harmful code.
• Harvesting or scraping data from the Platform without our written consent.
• Posting or sharing content that is defamatory, obscene, or violates the rights of others.
• Interfering with or disrupting the integrity or performance of the Platform.

Swabhimaan reserves the right to investigate and take appropriate legal action against anyone who, in our sole discretion, violates this provision.

5. Bookings and Transactions

The Platform facilitates connections between users and third-party service providers. Swabhimaan acts as an intermediary and is not a party to any service agreement between you and a provider. All bookings are subject to:

• The availability and specific terms of the individual service provider.
• Our Refunds and Cancellation Policy.
• Any additional terms displayed on the listing page at the time of booking.

By completing a booking, you agree to all applicable terms and take responsibility for reviewing the details of the service and provider before confirming.

6. Reviews and User Content

You may submit reviews, ratings, and other content ("User Content") on the Platform. By submitting User Content, you grant Swabhimaan a non-exclusive, royalty-free, perpetual licence to use, reproduce, modify, and display such content. You represent that:

• Your User Content is accurate and based on genuine experience.
• Your User Content does not violate any third-party rights or applicable law.

Swabhimaan reserves the right to remove any User Content that violates this Agreement or our community standards.

7. Intellectual Property

All content, design, graphics, logos, text, and software on the Platform are the exclusive property of Swabhimaan Eldertech Private Limited or its licensors, protected under Indian and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Platform content without our prior written consent.

8. Disclaimer of Warranties

The Platform and all its content are provided on an "as is" and "as available" basis. Swabhimaan makes no warranties, express or implied, regarding the accuracy, reliability, or completeness of any content or the availability of the Platform. We do not guarantee that the Platform will be error-free or uninterrupted.

9. Limitation of Liability

To the fullest extent permitted by applicable law, Swabhimaan and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use the Platform, including loss of data, revenue, or goodwill. Our total liability shall not exceed the amount you paid to Swabhimaan in the three months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account and access to the Platform at any time, with or without notice, if we believe you have violated this Agreement or for any other reason at our discretion. You may also delete your account at any time by contacting our support team.

11. Governing Law

This Agreement is governed by the laws of India. Any disputes arising under or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in Mumbai, Maharashtra.
